In October 2017, the Russian Supreme Court upheld the lower court’s decision to refuse recognition and enforcement of an SCC award relying, among other things, on the violation of due process. The Court found that the change of both the subject-matter and the grounds of the claim on the day of the hearing deprived the respondent of due process as it was precluded from presenting its case.
